Consequences of Possession of a Controlled Substance in New Jersey
Just about everybody knows that the sale of drugs like heroin is illegal in the state of New Jersey. Heroin is a controlled substance that does not have any recognized medicinal value, yet it is sold on the street often, and in an unregulated form whose composition can vary.
The seriousness of the crime involving possession of a controlled drug depends on the amount and type of the drug. An example of what will probably become a very serious charge is what happened at a police traffic stop on January 28, 2019 when a New Jersey State Police trooper pulled over a vehicle on Interstate 80 in Allamuchy, New Jersey.
$30,000 Worth of Heroin Found During Traffic Stop
On the night of January 28th, the state police trooper had pulled over Javier Cuevas, a 41-year old resident of Kingston, Pennsylvania, on Interstate 80 for a traffic violation. However, the trooper found that Cuevas was also intoxicated and driving under the influence and had in his possession, one pound of heroin, worth $30,000.
Also found was cannabis wax, which is a highly concentrated form of marijuana that is extracted into a wax-like form. Cuevas was first arrested by the state trooper for driving while intoxicated, but when the trooper inspected the car, he found the drugs and then Cuevas was sent to the Warren County Jail awaiting a bail hearing.
Further Investigation Also Reveals Drug Paraphernalia
During the state trooper's investigation, drug paraphernalia were also found in Cuevas' car. The possession of drug paraphernalia can be another separate charge in addition to the possession of the illegal heroin and cannabis wax.
Being charged with the possession of as much as a pound of heroin implies the intent to distribute or sell the drug, and penalties can be very severe and may include many years in prison. That's why hiring the most experienced and knowledgeable legal representation is always necessary to help combat these charges.
