Other than child custody and child support, property division is the most important part of most New Jersey and Pennsylvania divorces. Each former spouse wants to have enough resources to make ends meet after the marriage ends, and wants to avoid being saddled with excess debt. It takes an experienced attorney to protect your interests with regard to asset and debt division during divorce.
The Davis Law Firm, LLC, is home to an experienced brother-sister team of attorneys who are devoted to family law. We are passionate about helping our clients and their children get through divorce with as few negative consequences as possible. With regard to asset and debt division, we seek property settlements that are reasonable and that enable our clients to move comfortably into the next phase of life.

Our Approach to Division of Marital Property in New Jersey and Pennsylvania
Understandably, many of our clients come to us having no idea of the true value of their marital assets or debts. Accordingly, it is our practice, to conduct a thorough investigation and evaluation of marital assets and debts, then negotiate an “equitable distribution.” Remember, equitable does not necessarily mean 50-50. All assets acquired during marriage are considered marital property and, therefore subject to equitable distribution. Our Hamilton divorce lawyers handle all types of property and debt, including:
- The marital home and other real estate
- Family-owned businesses
- Retirement assets such as pensions, IRAs and 401(k) accounts
- Vehicles
- Credit card debt and mortgage debt
Some Assets Are Not Subject to Division
Property that may not be subject to distribution typically includes:
- Gifts or inheritances received by one spouse before or during the marriage
- Personal injury awards received by a spouse
- Proceeds of a pension that vested before the marriage
- Properties purchased entirely by one spouse with his or her separate funds
- A business owned by one spouse before the marriage (although the appreciated value of the business is subject to division)
